Wrongful Death
When a person is killed through the negligence or recklessness of another person or a business, the death is termed a "wrongful death", and the surviving family has the right to file a wrongful death lawsuit. In a wrongful death case the surviving family is considered to be the immediate family, such as the spouse, children, parents or siblings.
Wrongful deaths occur as a result of car accidents, tractor trailer accidents, boating accidents, accidents in the workplace, unsafe products, medical malpractice, and many other causes. Often the surviving family is saddled not only with hospital and doctor bills, funeral and estate administration expenses, but also faces the loss of future income.
The purpose of a wrongful death suit is to obtain compensation that will assist the surviving family in coping with their loss and added financial burdens. Generally, the surviving family is entitled to recover damages for pain and suffering experienced by the decedent prior to dying, the loss of the decedent's future income, and the loss of a spousal and/or parental relationship.
